Welcome to Clem. These Terms of Service ("Terms") govern your access to and use of our website [WEBSITE URL] (the "Site") and your purchase of products from Clem ("we," "us," or "our"). Our Site is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order with us. By placing an order, you confirm that the information you provide is accurate and that you're authorized to use the payment method submitted.

2. Products, Descriptions & Availability

We work to display our products, including colors and details, as accurately as possible. However, we can't guarantee that your screen displays colors precisely, and slight variations between the image and the actual item may occur.

All products are subject to availability. We may limit quantities, discontinue items, or correct errors in product descriptions, pricing, or availability at any time without prior notice — even after you've placed an order. If we cancel an order for these reasons after you've paid, we'll issue a full refund.

3. Pricing & Payment

All prices are listed in [CURRENCY, e.g. USD] and are subject to change without notice. The price that applies to your order is the price shown at checkout.

Payments are processed securely through Shopify's checkout and its supported payment providers, which may include Shopify Payments, Shop Pay, Apple Pay, Google Pay, PayPal, and major credit and debit cards. If you choose an accelerated checkout option such as Shop Pay, your use of that service is also governed by the provider's own terms. Where Shop Pay Installments or another "buy now, pay later" option is offered, it is provided by a third party (such as Affirm) under that provider's separate terms. Your payment information is handled by these payment processors and is subject to their terms and privacy practices; we do not store full card numbers.

By submitting payment, you represent that you are authorized to use the payment method. You're responsible for any applicable taxes and shipping charges, which will be shown at checkout.

We reserve the right to refuse or cancel any order we suspect to be fraudulent, unauthorized, or in violation of these Terms.

4. Orders & Order Acceptance

Your order is an offer to buy. We accept your order when we send an order confirmation or ship the items. We may, at our discretion, decline or cancel an order — for example, due to stock issues, suspected fraud, or pricing errors. If we do, we'll refund any payment already made.

5. Shipping & Delivery

We'll make reasonable efforts to ship within the timeframes shown at checkout, but delivery dates are estimates, not guarantees. We're not responsible for delays caused by carriers, customs, weather, or other events outside our control. Risk of loss passes to you once the carrier takes possession of your order.

For international orders, you are the importer of record and responsible for any customs duties, taxes, or fees charged by your country.

6. Returns & Refunds

7. Privacy

8. Promotions, Discounts & Codes

Discount codes and promotions are subject to their own terms, can't be combined unless stated, have no cash value, and may be modified or withdrawn at any time. We may void discounts obtained in error or through misuse.

9. Intellectual Property

All content on the Site — including the Clem name, logo, designs, graphics, text, photographs, and product imagery — is owned by or licensed to Clem and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. You may view and share content for personal, non-commercial use only.

10. User Content

If you submit reviews, photos, comments, or other content to us or tag us on social media, you grant Clem a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our brand and marketing. You confirm that you own or have the rights to any content you submit and that it doesn't infringe anyone else's rights. We may remove user content at our discretion.

11. Acceptable Use

You agree not to use the Site to: break any law; infringe others' rights; transmit harmful code or spam; attempt to gain unauthorized access to our systems; scrape or harvest data; or interfere with the Site's operation. Because our store operates on Shopify, your use of the Site must also comply with Shopify's Acceptable Use Policy. We may suspend or terminate access for anyone who violates these Terms.

12. Platform & Third-Party Services

Our Site is hosted and powered by Shopify, and we rely on Shopify and other third-party providers for payment processing, hosting, analytics, and related services. Any contract of sale for products you purchase is made directly between you and Clem — Shopify is the platform provider and is not the seller. We are responsible for our products and for fulfilling your order; we are not responsible for the third-party platforms and services themselves, which are governed by their own terms.

13. Disclaimers

The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. We don't warrant that the Site will be uninterrupted, secure, or error-free. Nothing in this section limits any rights you have under applicable consumer protection laws that can't be waived.

14. Limitation of Liability

To the fullest extent permitted by law, Clem will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you, and this section does not affect your non-waivable statutory rights.

You agree to indemnify and hold Clem harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

We may update these Terms from time to time. The updated version takes effect when posted to the Site, and the date at the top will be revised. Your continued use of the Site after changes means you accept the updated Terms. The Terms in effect when you place an order apply to that order.
